However, as easy as it is to eat our Chocolate Bitez, we are sure at some point you have asked yourself just how legal it is to eat them wherever you are. The recreational marijuana laws in Nevada can be confusing and not everyone is familiar with them. Just because recreational marijuana is legal, that doesn’t quite mean you can enjoy our delicious Chocolate Bitez just wherever you please just because they are edibles and not flower.

Where is it Legal to Use Marijuana in Nevada?

Just to clear the air a bit, and for the safety of our customers, here at OMG THC, we have decided to write a bit about the laws in Nevada when it comes to cannabis and infused edibles. That way, you’ll know exactly where and when you can enjoy one of our scrumptious Chocolate Bitez without breaking the law or endangering your fellow citizens.

While the recreational use of cannabis is legal in Nevada, that does not mean you can take a stroll down the street puffing on a joint or shoveling edibles into your gaping maw. There are many restrictions that were put into place when the recreational marijuana bill was passed. In fact, it is ILLEGAL to consume marijuana outside of a private residence. Now that brings to question, what exactly is a “private residence” as defined per the law?

Cannabis Consumption in a Private Residence

A private residence is loosely defined per the Nevada Revised Statutes Chapter 453, which governs the Controlled Substances Act. However, in the eyes of the law, it means a residence that is for the permeant dwelling of individuals. This means it is illegal to smoke in a hotel, casinos, schools, or universities. Even dorm rooms are a no-go. This means you can’t even smoke at that music venue during your favorite concert. Currently, there are some hotels that are newly “cannabis-friendly” however it is best to call ahead and ask prior to lighting up.

Cannabis Consumption in Social Settings

Nevada has legalized pot consumption in “permitted social venues” but that legislation has been delayed and is not yet in action. It is hoped that toward the end of 2022 there will be the first legal “pot bars” opening in Nevada.

So where does this all leave the legal consumption of edibles like our Chocolate Bitez? Edibles are much more discreet than lighting up a joint or pipe, but does that mean it is legal? The short and long answers to the question are both a hard no. Consuming marijuana in public is consumption regardless of how you consume it. However, unwrapping one of our Chocolate Bitez and eating it while you stroll down the street is very unlikely to draw any kind of attention.

Edibles, Chocolate Bitez, and Public Intoxication in Nevada

With just how easy it is to eat our Chocolate Bitez, the first thing we should do as a responsible dispensary is to strongly suggest that you only consume our products while in your own home, or another private residence. However, Nevada law does not state that it is illegal to have marijuana in your system in public. That would be ridiculous and impossible to enforce.

With that being said, we would like to briefly go over the public intoxication laws in Nevada. Edibles are not like smoking flower. The effects are more potent and last much longer than if you take a few puffs before leaving the house. Sometimes the intoxicating effects of our Chocolate Bitez can take upwards of two hours to hit, and sometimes people will continue eating more because they think they are not potent enough. If you are particularly impatient and do not have quite the cannabis tolerance you thought you had, there could be a problem, especially if you decide to leave the house.

While public intoxication is not a crime in Nevada, there are statutes that allow a police officer to arrest someone when “they are unable to care for their own health and safety, or they are threatening the health and safety of others.” In this case, they can detain you for up to 48 hours before letting you go. Unfortunately, when you force a police officer to throw you in a drunk tank, chances are you will get hit with some kind of resisting arrest charge as well.

This should go without saying. However, we’re going to say it anyway. Driving while under the influence of marijuana is a crime in Nevada. There are a lot of people who will claim that the police have no way of determining if you are under the influence of marijuana outside of taking a blood test. Well, we are here to tell you that just isn’t the case. 

Not only are officers trained to be able to detect tell-tale signs that you are high during a traffic stop, but they also now have a new little do-hickey called the Drager Drug Test 5000. While this sounds like a device straight out of Futurama, we assure you it is as real as a jail cell. The Drager test uses a simple mouth swab to detect marijuana, cocaine, methamphetamine, opiates, methadone, amphetamine, and benzodiazepines and it is being used by police at this very moment.

Needless to say, while our Chocolate Bitez are both discreet and delicious, the best and most safe way to enjoy them, and all of our other delicious edible treats we make here at OMG THC, is from the comfort of your own couch.
