Benjamin Bey of Soul D’licious Seasonings and co-host Stephanie Magurno of THC Production, LLC talk cannabis and immigration – how working in the industry has affected the citizenship applications of US legal residents, the possible impact on green card renewals, and even how owning a cannabis company in the US could lead to citizens of foreign countries being denied entry into the US.

They discuss citizenship, immigration issues, green cards, and their relationship to cannabis.

Immigration Status Issues

This topic arose after one of the staff members of THC Production, LLC actually ran into a problem getting her green card because she had a job in the legal cannabis industry. For example, anyone looking to get a green card who has dealt with the legal Vegas cannabis industry is still technically violating Federal Law. In other words, immigration laws relate to Federal Laws. Therefore, having anything to do with people who consume cannabis or work in the cannabis industry are technically violating the law.

As part of the immigration questionnaires, you are asked if you have had anything to do with illegal substances. Therefore answering honestly about your job or use of cannabis may disqualify you from getting a green card. Again, this was an issue for a person who had lived in the United States since she was 13 years old. In the end, she had many problems with her immigration and was unable to get her legal citizenship approved.

In fact, you may even be deportable if you have violated Federal law. This includes cannabis use or sales… even if it’s legal in the state. If the U.S. government decides that you have violated these rules, you’re are in violation of moral turpitude stipulations. They may even attempt to deport you during your green card application.

Even worse, this can include patients with cannabis prescriptions! In fact, leaving the country can be tough if you intend to get back in. The government may try to deny your entry back into the U.S. In a state where cannabis is legal, it makes for muddy waters.
